'Application Form' for Snow Season 2008

 

Snow Flirt "SF" (ABN 31 664 790 028)

 

  1. Advertisers must not display in print, online, TV, radio or any other marketing or media opportunity any tariffs cheaper than those displayed on the SF website. Prices displayed elsewhere may match but must not be cheaper than those on SF.

  1. Advertisers must provide details of their individual 'Privacy Policy' on the SF site, and advertisers accept full liability for misuse of personal details provided to them and accept their obligations under the Privacy Act (1988).

  1. Advertisers accept full liability for the content they provide for use within the SF site and accept ownership of the content including any copyright or intellectual property claims, inappropriate or unsolicited content claims, or claims relating to the Trade Practices Act (1974) which include but are not limited to; prohibiting unfair, unconscionable, misleading or deceptive conduct.

  1. SF reserves the right to alter the advertising rates to advertise on the SF site, page templates (including those featuring advertiser content), advertiser content inclusion options and all advertising opportunities available to new and renewing advertisers without consultation. Fully paid advertiser rates won't be changed during season.

  1. SF will make every effort to keep all components and functions of the site live and with no or minimal down time or malfunction, however SF accepts no liability or offers no compensation for downtime as a result of third party or other related downtime including but not limited to malicious damage, viruses, acts of god, technical errors or other.

  1. SF accepts no liability for differences between advertiser's visitation or reservations or marginal or no reservations as a result of consumer choices.

  1. SF will not switch advertiser content to publicly available ("live") until such time as SF have received all required paper work (including a signed copy of this agreement), advertiser content and any advertising fees due to be paid by the advertiser to SF.

  1. The advertiser understands that where post launch works are undertaken by SF on their advertisement, SF reserves the right to switch the content to inactive until such time as whatever agreed payment for these works or extra functionality is received.

  1. Purchase of advertising within the SF website is subject to the content restraints applied to advertising options including the space / limits available to sections, the inclusion and displaying of individual contact details, and the layout templates applied by SF.

  1. SF provides a portal where potential snow consumers can research, compare and then make a direct reservation to individual alpine tourism businesses via the SF site. Once consumers complete and submit a reservation direct to an operator it is the sole responsibility of that operator to manage that reservation.

  1. Advertisers are provided with a login that allows them to set the price or an 'Unavailable’ beside each individual night of the 2008 snow season, this price / per night display is the responsibility of the advertiser to keep updated and SF accepts no liability for errors or over sold inventory as a result of failure to keep this facility accurately updated. 

  1. SF reserves the right to refuse advertising participation.

  1. SF maintains full discretionary editorial control over all advertiser content with the exception of prices and may alter or remove or refuse text and image content without notice if it is deemed by SF to be of a standard not suitable for the quality of the site, inappropriate for the SF brand and market or out of the spirit of the site. Advertisers that continue to add such content will have their self edit suite locked.

  1. Contract period for the 2008 snow season is from the time advertising paperwork is submitted until the last day of the declared 2008 snow season. Cancellation of advertising on the part of the advertisers will see any paid advertising fees returned at a pro rata rate of time remaining in contract period less SF accrued design hours.

  1. The process when advertising is purchased;

    1. The advertiser provides SF with a completed and signed copy of this form,
    2. SF then provides the advertiser with a login name, password, customer reference number, invoice for advertising (7 day terms) and instructional PDF.
    3. The advertiser then logs in and adds the content of their ad within the pro forma.

 

  1. Failure to meet any of the above advertiser obligations may result in the removal or non displaying of any or all advertiser content on the SF website without reimbursement from SF, and may result in legal action seeking compensation by third parties or SF against the advertiser for any damage to the SF brand, good will or under other Australian Laws.
